Terms & Conditions

By placing an order with Kimmi's Cakes, you agree to the Terms & Conditions outlined below.

These Terms & Conditions apply to all products and services offered by Kimmi's Cakes, including celebration cakes, wedding cakes, cupcakes, biscuits, corporate orders, online shop purchases, classes, digital products and any other bespoke items.

Order Types

Online Shop Orders

Online shop orders are placed directly through our website and must be paid in full at the time of purchase.

Available collection, delivery or dispatch dates are shown during checkout.

Bespoke Orders

Bespoke orders include celebration cakes, wedding cakes, cupcakes, biscuits, dessert tables and custom products requiring a quotation, design work or consultation.

Your order is not confirmed until the required payment has been received.

Corporate Orders

Corporate orders include branded products, event catering, large quantity orders and repeat business orders.

Corporate orders require payment in full before production unless alternative terms have been agreed in writing.

Booking Fees & Payments

Celebration Cakes

A non-refundable booking fee of £75 may be required to secure celebration cake orders.

The remaining balance must be paid by the date stated on your invoice.

Failure to make payment may result in cancellation of the order.

Wedding Cakes

A non-refundable and non-transferable booking fee of £150 is required to secure your wedding date.

Your wedding date is not reserved until the booking fee has been received.

The remaining balance is due no later than 4 weeks before the wedding date.

Failure to make payment by the due date may result in cancellation of the booking without refund.

Corporate Orders

Corporate orders must be paid in full before production unless otherwise agreed in writing.

Quotes

All quotations are valid for 7 days unless otherwise stated.

Kimmi's Cakes reserves the right to revise pricing after this period.

Short Notice Orders

Orders placed within four weeks of the collection, delivery or event date may require full payment at the time of booking.

Date Changes & Postponements

Requests to move an event date are subject to availability.

If Kimmi's Cakes is unavailable for the requested new date, the booking will be treated as a cancellation.

Booking fees remain non-refundable.

Minimum Notice

All products are freshly prepared to order and minimum notice periods may apply.

Whilst every effort is made to accommodate short-notice requests, availability cannot be guaranteed.

Kimmi's Cakes reserves the right to decline orders where insufficient notice is provided.

Delivery & Setup

Delivery charges are calculated based on location and will be confirmed at the time of booking.

Certain large, tiered or structurally complex cakes may require delivery and professional setup by Kimmi's Cakes.

Delivery times are estimates and cannot be guaranteed unless specifically agreed in writing.

The client is responsible for ensuring suitable access is available for delivery and setup.

Additional charges may apply where access restrictions, delays or inaccurate information prevent timely delivery.

The client is responsible for ensuring a suitable display location is available. This should be level, stable and away from direct sunlight, radiators, heaters, open fires, open doors and high-traffic areas.

Once a product has been delivered and, where applicable, fully assembled and set up, responsibility transfers to the client, venue or nominated representative.

Kimmi's Cakes accepts no responsibility for any movement, damage or alteration carried out by venue staff, guests, florists, photographers or any third party after delivery and setup.

Collection times are typically between 10am and 11am unless otherwise agreed.

Customers are responsible for checking their order before leaving the premises.

Once an order has been collected, responsibility for the product transfers to the customer.

Orders not collected on the agreed date may be disposed of after 24 hours. No refund will be given for uncollected orders.

Design & Creative Licence

All products are individually handcrafted.

Inspiration images may be used as guidance; however exact replicas cannot be guaranteed.

Minor variations in colour, decoration, finish, flowers, printed elements and overall appearance may occur due to the handmade nature of the product.

Kimmi's Cakes retains full creative licence over all designs.

All designs, sketches, concepts and photographs remain the intellectual property of Kimmi's Cakes and may not be reproduced without permission.

Portion guides are provided as estimates and may vary depending on how the cake is cut and served.

Consultations & Tastings

Certain bespoke orders may include consultations, tastings or taster boxes.

Included consultations and tasting options will be confirmed at the time of booking.

Additional consultations, redesigns or tasting requests may incur additional charges.

Taster boxes and tasting products are non-refundable once collected, delivered or dispatched.

Product Freshness

All products are baked and prepared as close to the collection or delivery date as possible.

Products are best consumed within 48 hours unless otherwise advised.

Kimmi's Cakes cannot accept responsibility for products consumed outside the recommended period.

Storage & Care

Fondant cakes should be stored in a cool room at ambient temperature away from direct sunlight and heat sources.

Buttercream cakes should be refrigerated and removed approximately one hour before serving.

Storage instructions provided by Kimmi's Cakes must be followed.

Failure to follow storage guidance may affect the quality, stability and safety of the product.

Transport

Customers collecting products are responsible for transporting them safely.

Products should be transported on a flat surface, ideally in the footwell or boot of a vehicle with air conditioning operating during warm weather.

Kimmi's Cakes accepts no responsibility for damage occurring during transport after collection.

Weather & Environmental Conditions

Cakes and decorations may be affected by temperature, humidity and environmental conditions.

Every reasonable precaution is taken during preparation, transport and setup.

Kimmi's Cakes cannot accept responsibility for damage, movement, melting, cracking, leaning, bulging, collapse or deterioration caused by heat, humidity, direct sunlight, transportation, handling, venue conditions or unsuitable storage once the product has been collected or delivered.

Allergies & Dietary Requirements

Customers must inform Kimmi's Cakes of any allergies or dietary requirements when placing an order.

Whilst products can be made without specific ingredients, all products are prepared in a kitchen that handles nuts, peanuts, gluten, wheat, dairy, eggs, soya and other allergens.

Cross-contamination cannot be completely eliminated.

Customers with severe allergies should contact us before placing an order.

It is the client's responsibility to inform guests of any allergen risks.

Cake Stand Hire & Non-Edible Items

Cake stands may be hired subject to availability.

The client is responsible for any loss, damage or replacement costs associated with hired equipment.

Products may contain dowels, supports, wires, flower picks, toppers or other non-edible elements.

These must be removed before consumption.

Fresh flowers supplied by third parties remain the responsibility of the florist or supplier.

It is the responsibility of the florist or flower supplier to ensure any flowers supplied for use on cakes are non-toxic and suitable for food display purposes.

Kimmi's Cakes accepts no responsibility for contamination caused by unsuitable floral varieties.

Classes

Class places must be paid for in full at the time of booking.

Class bookings are non-refundable.

Where possible, transfers to an alternative class date may be offered at the discretion of Kimmi's Cakes.

Kimmi's Cakes reserves the right to cancel, postpone or reschedule classes where necessary. In these circumstances, an alternative date or refund will be offered.

Digital Products

Digital products, including guides, downloads, templates and online materials, are non-refundable once purchased.

All content remains the intellectual property of Kimmi's Cakes.

Purchasing a digital product grants a single-user licence only.

Digital products may not be copied, distributed, shared, reproduced, taught from commercially or resold without written permission.

Cancellations & Refunds

Booking fees and deposits are non-refundable.

Where work has commenced, refunds may not be available.

Cancellation requests must be made in writing.

Refunds are considered on a case-by-case basis and are subject to costs already incurred, preparation completed and ingredients purchased.

Bespoke products are exempt from standard consumer cancellation rights due to their personalised nature.

No refunds will be offered for products that have been collected, delivered, set up, cut, served, consumed or stored contrary to the instructions provided.

Complaints

Any issues with an order must be reported within 24 hours of collection or delivery.

For wedding cakes, any issues must be reported within 12 hours of delivery or setup.

Clear photographic evidence may be required.

If a complaint relates to taste or texture, a substantial proportion of the product may be requested for inspection.

Once a cake has been delivered, set up, cut, served, consumed or partially consumed, it shall be deemed accepted and fit for purpose.

No refunds or compensation will be considered where a third party has altered, repaired, moved, transported or otherwise interfered with the product before Kimmi's Cakes has had the opportunity to assess the issue.

We kindly request the opportunity to investigate and resolve any complaint before concerns are shared publicly or on social media.

Force Majeure

Kimmi's Cakes shall not be liable for delays, cancellations or failure to perform obligations due to circumstances beyond reasonable control, including illness, injury, accidents, extreme weather, transport failures, venue closures, utility failures, supplier failures or other unforeseen events.

In such circumstances, liability shall be limited to monies paid for the affected order.

Photography & Marketing

Kimmi's Cakes reserves the right to photograph products and use images for marketing, social media, website content, competitions, publications and promotional materials.

Personal client information will never be shared publicly without permission.
